(Persons Related to the Provisions of this Law)
Article 80. Any person who has any concerns relating to the provisions under Article 39 paragraph 2 of the Law (including cases applied accordingly under Article 43 paragraph 2, Article 55-(2) paragraph 2, Article 55-(3) paragraph 2, and Article 56-3 paragraph 2 of the Law) shall be defined as follows:
(1)Any applicant for permission, including the application for approval submitted by the New Tokyo International Airport Authority;
(2)Any person who has title, surface rights, perpetual lease of land, easement, stone quarrying rights, right of pledge, mortgage, rights derived from utility lease or lease over the land or buildings on an aerodrome area, an approach area or a projected area of transitional surface, horizontal surface, extended approach surface, conical surface or outer horizontal surface, and any other rights concerning the land or buildings;
(3)A person who has any mining rights, rights for utilization of a hot spring, fishery rights, entrance rights to a fishing lot, or rights for utilization of running water, sea-water, or any other water within the area specified by the preceding Item;
(4)Any local public entities governing the area specified under Item 2;
(5)Any person who utilizes the aerodrome.

 

(Notice of Hearing)
Article 81. The Minister of Transport shall, when conducting a public hearing according to the provisions under Article 39 paragraph 2 of the Law (including cases applied accordingly to Article 43 paragraph 2, Article 55-(2) paragraph 2, Article 55-(3) paragraph 2, and Article 56-(3) paragraph 2 of the Law), issue a notification of the following items in the Official Gazette ten days before the date of the hearing: proposed date, time and place of the public hearing, name of the presiding officer, and the name of the office, term, and number of copies of the written application and memoranda which are to be filed.

 

2. in the case of an inconclusive public hearing within the tune and date prescribed under the preceding paragraph, notwithstanding the provisions of the preceding paragraph, it is considered adequate for the presiding officer to orally announce the time, date and place of the remaining part of the public hearing, at the end of the first part of the hearing.

 

(Designation of the Presiding Officer)
Article 81.-(2). A public hearing shall be conducted by a presiding officer who is nominated by the Minister of Transport from among the government officials who are recognized to have no substantial interest in the case.
